ORDER Heard finally with the consent of both the parties.

This writ petition has been filed under Article 226 of the Constitution of India, seeking the following reliefs:-

(a) To issue an appropriate writ or direction to summon the records from the respondents of their impugned inaction.

(b) To issue a writ in the nature of mandamus directing the respondents to convene a Departmental Promotion Committee (DPC) to consider the case of the petitioner for promotion to the post of Assistant Grade II within a time bound period as deemed fit by this Hon'ble Court.

(c) Another relief which this court may deem fit in the interest of justice.

It is the case of the petitioner that the petitioner is working on the post of Assistant Grade III at Janpad Panchayat, Dahi, District-Dhar (MP) and was appointed on the said post on 25.03.2017, as per Rules MP Panchayat Service (Recruitment and General Conditions of Service) Rules, 1999. The petitioner is entitled to be promoted to the post of Assistant Grade II on completion of five years of service as per Schedule IV appended to the said Rules.

It is contended that the petitioner has already filed the representation dated 22.01.2026 which is Annexure-A/2 pending before the respondent No.3-Chief Executive Officer, Janpad Panchayat, Dahi, District-Dhar (MP).The said respondent is directed to consider the case of the petitioner sympathetically as per Schedule IV appended to the Rules i.e. MP Panchayat Service (Recruitment and General Conditions of Service) Rules, 199.

Needless to mention here that if the respondents found that the petitioner is entitled for the said promotion then they shall consider the case of the petitioner and convene a DPC for the said fact. Let the said exercise be done by the respondents/competent authority within a period of sixty days from the date of receipt of certified copy of this order.

It is made clear that this court has not expressed anything on the merits and entitlement of the petitioner, the respondents are free to consider the case of the petitioner, apart from the consideration which is spelt out in Schedule IV of the Rules of 1999, while convening the DPC.

With the aforesaid observation, this petition stands disposed of.
