ORDER

1. This is the second bail application filed by the applicant under Section

483 of Bhartiya Nagrik Suraksha Sanhita, 2023 (439 of Criminal Procedure Code, 1973) as he / she is implicated in connection with Crime No.53/2025 registered at Police Station Ravji Bazaar, District-Indore (MP) for offence punishable under Sections 406, 419, 420, 468, 471, 201, 34 of the IPC. The applicant is lodged in jail since 17.05.2025. Applicant's first bail application-M.Cr.C.no.45511/2025 was dismissed on merit by this Court vide its order dated 16.10.2025.

2. The allegation against the applicant is of his involvement in the aforesaid case of embezzlement to the tune of Rs.50 Lakhs. So far as the present applicant is concerned, it is alleged that he received around Rs.05 Lakhs arranging to open an account in the name of co-accused Anshuman Tripathi in which, the complainant's money was transferred and has also provided ATM and cheque book to the main accused Chetan Joshi.

Counsel for the applicant at the outset, has submitted that the co-accused Chetan Joshi has already been granted bail by this Court in M.Cr.C.No.33916/2025 dated 03.09.2025, with a condition that he should deposit a sum of Rs.10 Lakhs in the trial court; whereas against the present applicant, it is alleged that he had obtained a sum of less than Rs.05 Lakhs, and the applicant is ready to deposit a sum of Rs.02 Lakhs in the trial court. It is further submitted that the applicant is lodged in jail since 16.10.2025; the charge sheet has already been filed and the final conclusion of the trial is likely to take sufficient long time. Thus, it is submitted that the bail application be allowed and the applicant be released on bail.

Counsel for the respondent / State, on the other hand has opposed, and it is submitted that the applicant was instrumental in opening the Bank account of co- accused Anshuman Tripathi, in whose account the amount defrauded from the complainant was received, and thus, the applicant is the mastermind of the entire fraud, which is also reflected from the order passed by the trial court.

5. Heard. Having considered the rival submissions,perusal of the case diary, as also the order passed by this Court in the case of co-accused Chetan Joshi in M.Cr.C.no.33916/2025 dated 03.09.2025, who has been granted bail on his depositing a sum of Rs.10,00,000/-in the trial court, in such circumstances, when the applicant is also ready to deposit sum amount, this Court finds it expedient to allow the present bail application as well on applicant depositing a sum of Rs.3,00,000/- (Rupees Three Lakshs only) in the trial court.

Accordingly, without reflecting anything on the merits of the case, the application filed on behalf of the applicant is hereby allowed subject to deposit a sum of Rs.3,00,000/- (Rupees Three Lakhs only) by the applicant, as directed below and the said amount shall be subject to the final outcome of the case by the trial Court.

7. It is further directed that upon applicant's or any other person on his behalf depositing a sum of Rs.3,00,000/- (Rupees Three Lakhs only) in a fixed deposit in a nationalized bank and producing the receipt/certificate of the same before the concerned trial Court, he shall be released on bail on his furnishing a bond in the sum of Rs.25,000/- (Rupees twenty five thousand only) with one surety bond of the same amount to the satisfaction of the trial Court, to appear before the trial Court on the dates given by the Court.
