ORDER Upon oral request made by counsel for the applicant, this Court in the interest of justice, directs him to amend the cause title of the bail application on Board itself. Accordingly, the amendment is carried out on Board itself.
This is the first application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 filed by the applicant seeking grant of anticipatory bail in connection with Crime No.200 of 2025 registered at Police Station University, District Gwalior (M.P.) for the offence punishable under Sections
420, 120-B of IPC.
As per the case of the prosecution, the complainant Harishankar, son of Patiram, submitted a complaint before the Judicial Magistrate First Class, Gwalior under Section 156(3) of the Code of Criminal Procedure against the applicant and six other non-applicants alleging that the agricultural land bearing Survey No.199, ad-measuring 1.0410 hectares, jointly owned and possessed by Harishankar, Rakesh and Naresh, was inspected through the online Khasra for the year 2024, whereupon it was revealed that a sale deed in respect of Survey No.199 had been executed in the name of Suresh Kumar (present applicant), resident of Gwalior, who was authorized by Krishnalandcon Private Limited. The said sale deed bearing No. MP142602023A1220068 dated 28.07.2023 was shown to have been executed by Harishankar, Rakesh and Naresh in favour of the aforesaid company and was registered in the office of the Registrar, City Centre, Gwalior. However, the complainant Harishankar and his brothers Rakesh and Naresh never executed the said sale deed. It was further alleged that Krishnalandcon Private Limited, in criminal conspiracy with Suresh Kumar (the present applicant) and the Sub-Registrar, Gwalior, got the sale deed executed fraudulently in respect of their land. Pursuant to the order passed on the said complaint, present FIR was registered on 14.06.2025 at Police Station Vishwavidyalaya, District Gwalior, bearing Crime No.200/2025, for offences punishable under Sections 420 and 120-B of the Indian Penal Code.
Learned counsel for the applicant submits that that the applicant has been falsely implicated in the present case and no offence is made out against him. The applicant has neither forged nor fabricated any document, nor has he impersonated any person in the execution of the alleged sale deed. The applicant acted strictly in his capacity as an authorized representative of Krishnalandcon Private Limited, and the sale deed in question was executed through due process of law after due verification by the office of the Sub- Registrar. It is further submitted that the dispute, if any, pertains to title and ownership of land and is purely civil in nature, for which the complainant has an efficacious alternative remedy before the competent civil court. The present criminal proceedings have been initiated with malafide intent, solely to harass the applicant and to give a criminal colour to a civil dispute. It is further submitted that there is no material on record to establish the essential ingredients of the alleged offences under Sections 420 and 120-B of the Indian Penal Code, particularly the element of dishonest intention or criminal conspiracy on the part of the applicant. The registration of the FIR is based merely on bald, vague and unsubstantiated allegations, without any independent corroboration. It is further submitted that the allegations levelled by the complainant are based on incorrect and fabricated facts and have been wrongly attributed to the applicant.
