ORDER This is first conditional bail application filed on behalf of applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of temporary bail.
2. The applicant was taken into custody on 11/10/2025 in connection with Crime No.381 of 2025 registered at P.S. Madan Mahal, District-Jabalpur for the offence punishable under Sections 109, 3/4 of B.N.S. and Sections 25, 27 of Arms Act.
3. Prosecution story in brief is that on 07.10.2025 at about 4:22 pm, the applicant came to complainant restaurant with a pistol in his hand and fired at complainant with the intention of killing him, on the basis of which FIR has been lodged against the applicant.
4. Learned counsel for the applicant submits that the applicant's wife needs medical attention, therefore, he may be granted temporary bail for 30 days so as to help his wife in medical emergency.
5. Learned counsel for the respondent/State opposed the grant of temporary bail to the applicant .
6. Heard learned counsel for the parties and perused the documents.
7. Considering the report from KJ Memorial Hospital, Jabalpur, whereby it is indicated that health of the new borne child as well as mother is not keeping well and require continuous attention for some family member, as the applicant is the father of the new borne child and considering the nature of illness of the wife as well as the new borne son, considering the peculiar facts, the interest of justice will survive by granting temporary bail to the present applicant for a period of fifteen days for release from Jail.

Accordingly, it is directed that applicant be released on temporary bail for a period of fifteen days from the date of his release on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial Court, for his regular appearance before the trial Court during trial with a condition that he shall remain present before the concerned Court on all the dates fixed by it during trial. He shall abide by all the conditions enumerated under Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023.
8. However, it is made clear that applicant shall surrender immediately after a period of fifteen days from the date of his release on the evening of fifteenth day before the trial Court. It is also made clear that if the applicant does not surrender after prescribed period of fifteen days then, trial Court shall be free to take necessary steps for taking him into custody.
During applicant's release on bail for fifteen days, he will mark his appearance before the concerned Police Station after completion of one week of his release.
10. M.Cr.C. stands allowed and disposed of.
