IN THE HIGH COURT OF MADHYA PRADESH AT JABALPUR

Anil Singh – Appellant
Versus
State of Madhya Pradesh – Respondent
WRIT PETITION No. 11341 of 2025|WRIT PETITION No. 18974 of 2025|WRIT PETITION No. 24052 of 2025

Important Points

A Public Interest Litigation is liable to be dismissed if the competent authority has already enquired into the matter and closed it, and where the petitioner exhibits professional misconduct or conflict of interest by representing a party they had previously accused.

Subject

Administrative Law - Public Interest Litigation

Headnote

The petitioner, a practicing advocate and LL.M. student, filed three Public Interest Litigations challenging the appointments of the authorities of the Madhya Pradesh Private University Regulatory Commission, alleging misuse of public funds and official positions. The petitioner sought a fair impartial inquiry, the registration of criminal cases, and the recovery of embezzled government money. The court examined whether the petitions were maintainable given that the petitioner had previously filed complaints with the Lokayukta which were subsequently disposed of. Furthermore, the court noted a conflict of interest, as the petitioner acted as counsel for one of the respondents in subsequent proceedings, suggesting that information may have been selectively collected and suppressed. These Writ Petitions i.e. W.P. No.11341/2025, W.P. No.18974/2025 and W.P. No.24052/2025 are dismissed with the cost of Rs.25,000/- (Rupees Twenty Five Thousand Only) each.
