IN THE HIGH COURT OF MADHYA PRADESH AT JABALPUR

WP No. 44909 of 2026

CNR No.: MPHC010798052026

(DR SARVJEET SINGH AND ANR Vs THE STATE OF MADHYA PRADESH AND ANR)

Dated : 02-11-2026

Shri Aditya Sanghi - Senior Advocate with Ms.Vinita Ahuja and Ms.Alka Singh - Advocates for the petitioners.

Smt. Janhavi Pandit - Additional Advocate General and Shri B.D.Singh - Additional Advocate General for the respondents on advance copy.

1. Learned counsel for the petitioner seeks leave of this Court to add some party as respondents.

2. Leave is granted to add party respondents.

3. It is the case of the petitioners that the petitioners is a candidate for admission for NEET PG courses who is pitched against the inservice candidates. According to the petitioner, MP State Government has provided a separate quota reserving 30% of the seats for the in-service candidates. In view of Rule 14 of Madhya Pradesh Chikitsa Shiksha Pravesh Niyam, 2018, the weightage of marks at 10%, 20%, and 30% based on the length of service with the State Government is added as an incentive. As a result, the in- service candidates who have received NEET PG score much below the petitioners are catapult higher than the petitioners, thereby reducing the chance of the petitioners to opt for the subjects/discipline which they want to pursue on the basis of their NEET score.

4. By way of an illustration, it is pointed out by drawing attention to Annexure P3 that an in-service candidate having All India ranking at 13865 with addition of the marks for their experience has been placed at All India ranking 333, meaning thereby over and above the reserved quota of 30%, the in-service candidates on the strength of the added marks for their experience, will also be pushed higher in All India ranking and will be able to opt for the courses even before the petitioners, though without the added marks the petitioners are at Sr. Nos. 82 and 117 respectively.

5. It appears that the modus adopted by the respondent/Director for admitting the students to the course is having an effect by which the in- service candidates are getting dual benefit both in the quota of reservation of 30% and the addition of marks on the basis of their experience which is causing great injustice to the fresh students who are having higher NEET PG score.

6. Considering the submissions made by the petitioners, issue notice to the respondents.

7. The petitioners are permitted to serve the respondents by Humdast service on taking steps in this regard.

8. In addition to aforesaid, the petitioners are also permitted to serve the respondents through e-mail.

9. In the meantime, the parties to complete the pleadings.

10. Considering the urgency with which the matter is required to be taken up and the ongoing process of allotment of seats, the Court deems it fit to direct that the Respondents shall ensure the allotment of branches/ subject to inservice candidates restricting to the seats of 30% as per the Government and Autonomous Medical Colleges of Madhya Pradesh - Category wise Seat Distribution of PG Degree vacancies (MD/MS) NEET PG-2026-27 (30% Inservice Open) (First Round) (Dated 21.10.2026) and Private Medical Colleges of M.P. Category wise Seat Distribution of P.G. Degree vacancies (MD/MS) NEET P.G. 2026-27 (30% Inservice quota- Institutional (Open) (First Round) dated 21.10.2026, which is also uploaded on the website of the Director Medical Education, Bhopal and also uploaded in the ERP at Sr.No.4-Schedule and visible on the Administrative website of the Respondent/ Office of Commissioner Medical Education Bhopal Madhya Pradesh Tentative Time Schedule for M.P. State Combined Neet PG Counselling.

11. Stand over to 05.11.2026 at 2:30 PM.
