1. This Revision Petition has been filed under Section 58(1)(b) of the Consumer Protection Act, 2019 (the “Act”) against the State Consumer Disputes Redressal Commission, Delhi („State Commission‟) Order dated 06.10.2021 in FA No. 1036 of 2017 holding that CC No. 1036 of 2017 was not maintainable before it.
2. As per report of the Registry, there is 124 days delay in filing this Revision Petition. The delay is condoned for the reasons stated in IA No. 5348 of 2023. Further, for convenience, the parties are referred to as placed in the original Complaint filed before the District Forum.
3. Perusal of records reveals that, the complainant first approached the State Commission, Delhi and filed Complaint Case No. 1036 of 2017. In the absence of the complainant, vide Order dated 06.10.2021, the learned State Commission considered that the total aggregate value exceeds Rs. One Crore, which is beyond the pecuniary jurisdiction of the State Commission and hence the complaint was not maintainable.
