Procedural fairness requires that appellants be informed of defects in their appeals to ensure judicial efficiency and the right to a fair hearing.
Headnote:(A) Consumer Protection Act, 2019 - Sections relevant to appeals against orders of State Commission - The appellants challenged the orders of the State Commission regarding consumer complaints pertaining to real estate transactions. The appeals were filed due to alleged defects in the orders and the need for further hearings. (Paras 1-3)
(B) Procedural Fairness - The court emphasized the importance of procedural fairness in addressing defects in appeals and the necessity for the Registry to communicate such defects to the appellants. The court noted that the appellants are entitled to know what defects need to be cured for their appeals to proceed. (Paras 4-5)
