The Revisionist/opposite party No.1 has preferred the present Revision Petition under the Consumer Protection Act , 2019 challenging the impugned orders dated 21.11.2022 and 05.12.2022 passed by the District Consumer Disputes Redressal Commission, West Delhi, in Complaint Case No.620/2022. 2. Vide impugned order dated 21.11.2022, revisionist / opposite parties were proceeded ex-parte by the the District Commission. the same has been reproduced as under:-
3. Vide impugned order dated 05.12.2022, the District Commission has dismissed the application filed by the Revisionist/Opposite part No.1 for review of order dated 21.11.2022. “By way of this order we are disposing off this application filed under Section 40 of CP Act 2019 by OP-1.
It is stated in the application that on 21.11.2022, the applicant tried his level best to appear online, however due to technical difficulty he could not appear before this commission on time and further due to his non-appearance the Hon’ble court was pleased to proceed OP-1 as ex-parte vide its order dated 21.11.2022. It is further stated that the non-appearance was neither intentional nor deliberate.
