ORDER

1. The petitioner/complainant is the husband of late Mrs. Geeta Singh who had taken a Life Insurance Policy from the respondent for a sum of Rs.2,00,000/- and the first instalment of the premium of Rs. 19,310/- was paid. The proposal form of the policy has been filed as Annexure A-l and it is the case of the petitioner that the same was not filled up by the insured and all the columns were filled up by the agent Mr. Sheshnath Singh.

2. The insured died during a child delivery caesarean section whereafter the complainant set up his claim but the same was repudiated on 18.11.2004 on the ground that the insured had supressed the material fact of her seven months pregnancy and had made a false declaration to that effect. The repudiation letter is extracted hereinunder: -
