ORDER
The main grievance of the Appellant / Complainant is that the Ld.
State Commission in CC/06/2011 vide order dated 01.10.2019 considered that the cause of action in the matter arose on 09.03.1993 and that the Complaint was filed on 25.05.2011 and thus there was a substantial delay of over 8 years in filing the Complaint and thus dismissed the Complaint. The Complainant contended that the consideration made by the State Commission is not based on facts and there was no delay is filing the Complaint.
Heard Learned Counsels for both the parties in detail and perused the records. It is an admitted position that Shri. RS Krishnan was the original allottee who purchased 2000 units issued by the Opposite Party (OP) in the year 1964. Shri. RS Krishnan died on 30.12.1992. Thereafter, Mr. K. Subramanian the LR (son of late Shri. R.S. Krishnan) approached the Opposite Party with request to transfer of 2000 units purchased by his father Shri. R.S. Krishnan in his name vide letter dated 19.04.1993.
The request of Shri. Mr. K. Subramanian was duly considered and responded by OP vide letter dated 19.04.1993 acknowledging receipt of the request as well as the death certificate of his father. Acco
