1. The present Consumer Complaint, i.e., CC/331/2019, is filed under Section 21 of the Consumer Protection Act, 1986 (for short, the Act), by Mrs. Suchi Banyal and Lt Col Niraj Banyal (hereinafter referred to as the Complainants/Buyers) against M/S Dream World Landmarks LLP (hereinafter referred to as the Opposite Party/Builder), seeking refund of amount paid along with compensation and other reliefs.

2. The brief facts leading up to the present Complaint are that the Complainants, lured by the promises of Opposite Party, booked an apartment (hereinafter referred to as the ‘Unit’) measuring 1256 sq. ft. vide Application dated 03.12.2014 for a total consideration of Rs.79,41,263/- in the project of the Opposite Party called “Godrej Prana” located at Undri, Taluka Haveli, District Pune, Maharashtra and agreed for construction linked payment plan. The relevant details of the Unit of the Complainants and other related details is in the table as under:
