1. The present Consumer Complaint, i.e., CC/2668/2018, is filed under Section 21 of the Consumer Protection Act, 1986 (for short, the Act), by Mr. Banamali Pramanick (hereinafter referred to as the Complainant) against M/s Murshidabad Medical College and Hospital (for short, MMCH) Through Chief Medical Superintendent and Others (hereinafter referred to as the Opposite Parties) seeking compensation for negligence in the medical treatment by the Opposite Parties.
2. The brief facts of the Complaint are that the Complainant is the father of the deceased Ms. Baisakhi Pramanick, a 34 year old healthy, active woman who was pursuing M.Sc. Course in Nutrition Management and working as a school teacher. She experienced severe abdominal pain and was admitted to Murshidabad Medical College and Hospital (hereinafter referred to as Opposite Party No. 1 or MMCH) on 25.12.2016 at around 10 PM, where she was treated by Emergency Medical Officer Dr.Hirak Kumar Das (hereinafter referred to as Opposite Party No. 2), two Physicians Dr.Atanu Roy Chowdhury (hereinafter referred to as Opposite Party No. 3) and Dr.Hamid Ali (hereinafter referred to as Opposite Party No.
