ORDER
This batch of 66 Revision Petitions by a set of retired government employees, is listed with office report, seeking direction as to whether fresh notices need to be issued to the parties for listing the cases for final hearing.
Having regard to the nature of the relief prayed for in the complaints, and bearing in mind the fact that the issue raised in these Revision Petitions stands concluded against the Petitioners/Complainants by a decision of the Hon’ble Supreme Court in Jagmittar Sain Bhagat And Others vs. Director, Health Services, Haryana And Others, (2013) 10 SCC 136, we deem it unnecessary to issue notices to the parties in these Revision Petitions.
The short controversy raised in these Revision petitions pertain to the computation of family pension payable to the Complainants under the Employees’
Pension Scheme 1995, which came into force w.e.f. 16.11.1995. In short, the grievance of the Petitioners is that on their exit from pension fund membership after 15
of past service up to the said date plus length of actual service after 15th November 1995. Although, their claim was accepted by the District Forum and a direction was issued to the Provident Fund Commissioner to pay family pension to the complainants as per their own calculations, on being challenged by the Provident Fund Commissioner, vide its order dated 05.12.2007 the State Consumer Disputes Redressal Commission, Maharashtra at Mumbai (for short ‘the State Commission’) set aside the said direction. The State Commission accepted the stand of the Provident Fund Commissioner to the effect that under the said Pension Scheme, a Consumer forum did not have jurisdiction to entertain the Complaints by government employees, overriding the procedure laid down under the Scheme and the Rules framed thereunder. The State Commission also observed that the Complainants having retired sometime between the years 1996 to 2000, the Complaints filed by them in the year
2005 were clearly barred by limitation. It finally concluded thus:
“……. In our view determination of family pension is exclusive province (prerogative) of Provident Fund Commissioner under Employees Provident Fund and Miscellaneous Provisions Act, 1952 read with Employee Pension Scheme, 1995. This is administrative or executive job of provident fund Commissioner, who is sole authority to decide the monthly pension payable to the persons concerned. His authority cannot be challenged by filing consumer complaint. In fact, if at all the respondents were aggrieved by the order passed by provident fund Commissioner, further appeal or representation should have been addressed to the authorities mentioned under Employees Provident Fund and Miscellaneous Provisions Act, 1952, but they should not have filed consumer complaint alleging deficiency in service on the part of the appellant herein. If, the Government Authority is entrusted to do a particular job decides any issue wrongly, the representation should be addressed to its higher authorities pointing out the error committed by the deciding authority, but filing of consumer complaint in such matters is unwarranted in law and therefore, we are of the view that the Forum below usurped the jurisdiction not vested in it and patently committed error of law in entertaining these complaints. The Forum below also did not get itself acquainted with various individual factors required to be taken into account while fixing monthly family pension because some of them had taken V.R.S. Some of them have taken two rupees, some of them had resigned, some of them had retired at the superannuation, some of them had sought reduced pension by enhanced option and some of them grabbed substantial amount by commuting their pension.
