BEFORE:
HON'BLE MRS. JUSTICE SAROJ YADAV , PRESIDING MEMBER FOR THE PETITIONER:
FOR THE PETITIONER : MR. ASHWINI KUMAR MISHRA, ADV. (IN VC)
DATED: 06/01/2026
ORDER
1. The present Revision Petition has been filed under Section 58 (1) (b) of the Consumer Protection Act, 2019 by the petitioner/opposite party being aggrieved of the order dated 06.05.2024, passed by the learned State Consumer Disputes Redressal Commission, Uttar Pradesh, Lucknow, (for short the ‘State Commission’) in First Appeal No.2164 of 2014, arising out of the order dated 25.02.2014 passed by the learned District Consumer Disputes Redressal Forum, Shahjahanpur (for short the ‘District Foum) in Complaint Case No.104 of 2013.
2. Heard the learned counsel for the petitioner on the delay condonation application and also on the Memo of Revision Petition.
3. The present revision petition has been filed with a delay of 149 days as reported by the Registry, beyond the prescribed period of 90 days for filing of the revision petition.
4. The impugned order was passed on 06.05.2024, copy of which was delivered to the petitioner on 13.11.2024. The present revision petition has been filed on 10.07.2025.
5. The learned counsel for the petitioner has submitted that the delay was caused for the reason that the previous counsel, who contested the appeal before the learned State Commission on behalf of the petitioner, did not provide the documents / copies to the petitioner in time, despite of repeated requests through E-mail. Finally, the previous counsel sent copies in the month of August, 2025. Thereafter, the copies were got translated and the revision petition was prepared and filed.
6. Considered the submissions made and grounds taken in the delay condonation application. The grounds taken and submissions made are not convincing and sufficient enough to condone a huge delay of 149 days in filing of the present petition.
7. Furthermore, the perusal of the orders of both the foras below show that the petitioner has been directed to return the money paid by the respondent/complainant, along with interest @ 6% per annum. There appears no illegality, irregularity or jurisdiction error in the orders passed by both the foras below. Hence, the present revision petition deserves to be dismissed and is dismissed accordingly, as time-barred as well as on merits, at the admission stage itself.
Interim applications pending, if any, shall stand disposed of accordingly.
Let the file be consigned in the record room after necessary action.
