1. The complainants/ respondent nos. 1 to 4 herein preferred CC/47/2014 before the SCDRC, Madhya Pradesh, alleging deficiency and unfair trade practice on the part of the appellant- Insurance Company on repudiating the claim arising out of a Home Safe Plus – Secure Mind Policy, that was acquired for securing the payment of the loan extended to the insured for purchase of the property in question, in the event of the happening of the insured events as detailed in the policy. The dispute centres around a contest with regard to the nature of the major medical illness of “End Stage Renal Failure” as claimed by the complainants. The Insurance Company has taken a stand that there is no evidence nor is there any material to construe the existence of such a disease, as such the claim was not indemnifiable.
