NATIONAL CONSUMER DISPUTES REDRESSAL COMMISSION
A. P. Sahi, President
PREM SHANKAR PANDE – Appellant
Versus
MRS HEENA M KASHMIRI – Respondent
REVISION PETITION NO. NC/RP/380/2026 | NC/IA/4171/2026
For the Appellants/Petitioners: Meenakshi Rawat, Rajesh Chhetri, Sunil Singh Rawat
For the Respondents:
Inordinate and unexplained delay in filing an appeal cannot be condoned, especially when the party has admitted knowledge of the order in execution proceedings, as orders attain finality under Section 24 of the Consumer Protection Act, 1986.
Headnote:(A) Condonation of Delay - Inordinate Delay - Admission of knowledge of the impugned order in execution proceedings precludes the condonation of delay after several years, as such delays are considered unexplained. (Para 15, 16)
(B) Finality of Orders - Consumer Protection Act, 1986 - Section 24 - An order of the District Commission becomes final if no appeal is preferred within the prescribed limitation period, and allegations of fraud cannot override the statutory bar of limitation in the absence of a cogent explanation for the delay. (Para 17)
Issues: Whether the inordinate delay in filing the appeal could be condoned on the grounds of fraud when the petitioner had admitted knowledge of the order since February 2014.
