This revision petition has been filed with a delay of 368 days. We passed the following order on 02.06.2026 for filing of an appropriate affidavit explaining the delay:

“On going through the pleadings, we find that there is a very casual drafting about delay condonation application IA No. 5439 of 2026 in para-3 and 4 and, in our prima facie opinion, it is an 'excuse' and does not amount to an ’explanation' as held by the Apex Court in the case of Sheo Raj Singh & Ors. Vs. Union of India & Anr., (2023) 10 SCC 531. Learned counsel for the petitioner however submits that he may be permitted to file a better affidavit explaining the delay. Apart from this, we also find that the delay is of 368 days. The affidavit should therefore explain it in detail as to what had caused the delay in filing of the present revision petition.

Apart from this, the respondent/caveator is already represented and Mr. Nagpal, learned counsel, is physically present who travels from Rajasthan to attend the cases.

In the said background, it is directed that the petitioner shall pay a sum of Rs.10,000/- to Mr. Nagpal for the ancillary expenses for attending to this case.
