ORDER

1. The captioned petition bearing C.P. (IB) No. 293/MB/2024 has been filed on 02.04.2024 by Onassis Auto Limited (“Petitioner”) against M/s. Robert Bosch Automotive Steering Private Limited (“Respondent No. 1”) and Mr. Sunit Jagdishchandra Shah (“Respondent No. 2”) viz. the erstwhile Liquidator of Respondent No. 1.

1.1. The captioned petition was initially filed u/s. 65 of the Insolvency and Bankruptcy Code, 2016, (“IBC, 2016) r/w. Rule 11 of the National Company Law Tribunal Rules, 2016. The Petitioner has admittedly carried out an amendment in the captioned petition by way of an Interlocutory Application bearing I.A. No. 5633 of 2024 to rectify “..certain inadvertent clerical errors committed by the Applicants in the Petition.” The said amendment was allowed by this Bench vide Order dated 06.01.2025. The captioned petition is now operatively filed u/s. 65 r/w. 60(5) of IBC, 2016 r/w. Rule 11 of the National Company Law Tribunal Rules, 2016.

2. By way of the captioned petition, the Petitioner has sought for the following (Interim and Final) reliefs:“

V. INTERIM RELIEFS In view of the aforementioned facts and circumstances, it is just and necessary that this Hon’ble Tribunal may
