ORDER

1. This Application has been filed by Vikram Prabhakar (hereinafter called as Successful Bidder/Applicant) under sub-section (5) of section 60 of the Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as “IBC/Code”) r/w Rule 11 of the National Company Law Tribunal Rules, 2016, inter-alia, praying to this Hon’ble Tribunal to direct the Liquidator to issue sale-certificate in favour of the Applicant for being the Successful Bidder after having paid auction consideration amounting to Rs.17,78,00,000 (Rupees Seventeen Crore Seventy Eighth Lakhs) in pursuance of the E-auction conducted on 12.11.2023 for the sale of M/s Vikram Structures Private Limited as a going concern.

2. Brief facts of the instant Application which are relevant to the issue in question are as follows:-

(a) This Tribunal, vide, its order, dated 13.04.2023 in I.A. 526/BB/2022 passed an order for the liquidation of the Vikram Structures Private Limited (“Corporate Debtor”) under Section 33(2) of the Code and appointed the Mr. Surender Devasani with IBBI Registration no.- IBBI/IPA-001/IP-P00775/2017-2018/11348 as the Liquidator of the Corporate Debtor.
