1. The prayer made in this Transfer Application reads as follows: -

“a. Direct that Company petition bearing No. 139 of 2023 pending before the Hon’ble NCLT Mumbai Bench V be transferred to the Hon’ble NCLT Mumbai Bench I; and/or b. pass any other and further orders that this Hon’ble Tribunal may deem fit”

Facts of the case:

2. The present Transfer Application is filed by the Applicant under Rule l6(d) of the National Company Law Tribunal Rules, 2016 for transferring the Company Petition bearing no. 139 of 2023 pending before Court-V, NCLT Mumbai Bench to Court-1, NCLT Mumbai Bench.

3. The petitioner company was primarily engaged in the business of development, construction and operation of renewable energy projects. It is a wholly owned subsidiary of IL&FS Energy Development Company Limited ("IEDCL") which in turn is a subsidiary of the Infrastructure Leasing & Financial Services Limited ("IL&FS"). The “IL&FS” and its nominee holds 92% Equity Shares of IEDCL and IL&FS Energy Development Company Limited and Its Nominees holds 100% Equity Shares of petitioner company.
