The liquidation process under the Insolvency and Bankruptcy Code, 2016 is a time-bound mechanism, and claims not filed within the prescribed time period should not be entertained, even if the applicant is a government authority.

Headnote:

Insolvency and Bankruptcy - Liquidation - Section 42 - Delay in Filing Claim

Fact of the Case:

The Applicant, Assistant Commissioner, CGST & CX, filed an application under Section 42 of the Insolvency and Bankruptcy Code, 2016 against the Liquidator of M/s. Crystal Cable Industries Limited, seeking condonation of delay in filing the claim before the Liquidator and to direct the Liquidator to accept the claim of the Department.

Finding of the Court:

The Tribunal dismissed the application, holding that the Applicant failed to file the claim within the prescribed time period and the delay cannot be condoned. The Tribunal relied on the judgments of the Supreme Court and NCLAT, which emphasize that the liquidation process is a time-bound mechanism and claims not filed within the time period should not be entertained.

Issues: Whether the delay in filing the claim before the Liquidator can be condoned and the Liquidator be directed to accept the claim of the Department?

Ratio Decidendi: The Tribunal held that the Applicant, being a government authority, has neglected and failed to file its claim before the Liquidator within the given time period. The Tribunal also noted that the Applicant failed to file the appeal challenging the Liquidator's decision within the prescribed time period. The Tribunal relied on the settled position of law that the liquidation process is a time-bound mechanism, and claims not filed within the time period should not be entertained.

Final Decision: The Tribunal dismissed the application.
