This is an application filed by the Applicant/IRP under Section 43(1) of the IBC, 2016 with the following prayers: -

(i) Allow the present application.

(ii) Pass an order declaring the transactions as enumerated above, carried out by the Respondents totalling to INR 2,03,04,083/- (Two Crore Three Lakhs Four Thousand Eighty-Three Rupees Only) as “Preferential Transactions” prescribed under Section 43 of the Code.

(iii) Pass an order for reversal of said transactions totalling to INR 2,03,04,083 (Two Crore Three Lakhs Four Thousand Eighty-Three Rupees Only) and issue directions to such persons to pay such sums respect of benefits received by them from present Corporate Debtor - M/s Greater Kailash Hospitals Pvt. Ltd., to the bank account of CD maintained by Resolution Professional for the purpose of CIRP.

(a) Respondent No. 3 - Atul Agrawal - INR 30,50,000

(b) Respondent No. 1 – Anil Bandi [Son of Late Kanhaiyalal Bandi and Late Smt. Sarla Kumari]-INR 79,02,492 for benefit received by Late Kanhaiyalal Bandi and INR 75,96,591 for benefit received by Late Smt. Sarla Kumari.

(c) Respondent No. 2 – Radhika Bandi [Daughter of L
