ORDER
1. This Application has been filed by the Applicant i.e. ICICI Bank Ltd. V. Relief or order sought:
In light of the facts as stated above, it is most respectfully prayed that this Hon’ble Tribunal may be pleased:
a. To permit the Applicant herein to join the Captioned Proceedings as Party Intervenor and accordingly direct the Respondents to make the Applicant herein a party to the Captioned Proceedings;
b. To not pass any further directions or make any final adjudication in the Captioned Proceedings and keep the Captioned Proceedings in abeyance pending the final disposal of the Section 7 Application; and
c. To pass such other and further reliefs as may be deemed just, fit and proper in the interest of justice.
2. It is stated in the application that Jayprakash Associates Limited (JAL) and Jaypee Infrastructure Development Limited (JIDL) filed CA No. 174/ALD/2017 and subsequently CP No. 19/ALD/2018 before this tribunal for seeking approval of the Scheme of Arrangement between JAL and JIDL and their respective shareholders and creditors (“Scheme of Arrangement”) with respect to transfer of residual debt in JAL to JIDL along with certain real estate assets.
