1. The present Interlocutory Application IA 1161 of 2020 is filed in Petition CP No. 1387 of 2017 by Axis Bank Limited in terms of Section 60 (5) of the Insolvency and Bankruptcy Code, 2016 in the matter of Reliance Communication Limited seeks following relief;
a. Setting aside the impugned communication/order dated 14.07.2020 (Exhibit ‘CC’) passed by the Respondent/Resolution Professional;
b. Ordering that the impugned reduction in admitting claim of the Applicant from INR 20,89,44,35,906/- to INR 89,25,24,256 as being bad in law and reinstate the admitting claim of the Applicant to INR 20,89,44,35,906/- and accordingly ordering and directing both Respondent/Resolution Professional and the CoC to proceed on this basis in all matters concerning the CIRP and the Resolution Plan of the Corporate Debtor;
c. Pending the hearing and final disposal of this Application, the Hon’ble Tribunal be pleased to stay all further proceedings in the CIRP of the Corporate Debtor, including the Section 31 Application viz. Miscellaneous Application No. 883/2020;
d. Ad-interim reliefs in terms of the prayers (a) to (c) above;
