ORDER
1. The present Application is filed by Catalyst Trusteeship Limited (hereinafter referred to as “Applicant/Creditor”) against Mr G Yoganand the personal Guarantor to the corporate debtor Manjeera Retail Holdings Private Limited under section 95 of The Insolvency and Bankruptcy Code, 2016(herein after referred as the ‘IBC,2016’) r/w Rule 7(2) Insolvency and Bankruptcy Rules, 2019, seeking to initiate Insolvency Resolution Process against Personal Guarantor to the Corporate Debtor for a total outstanding amount of Rs. 202,44,23,868/-.
2. The present Application was filed before this Tribunal on 07.11.2022, and the counter was taken on 09.01.2023. In accordance with the judgment of the Hon'ble Supreme Court of India in Surendra B. Jiwarjka vs. Omkar Asset Constructions, this Tribunal appointed Shri Maruti Venkata Subba Rao having IBBI Registration No. IBBI/IPA-002/IP-N
