1. The present Intervention Petition has been filed by the Applicant, i.e. Fab Metals Private Limited, which is the Successful Resolution Applicant (SRA/Applicant) through its director, Mr. Vimal Shah, as authorised by the Board Resolution dated 28.04.2023, whose Resolution Plan dated 01.12.2021 has been approved by the Committee of Creditors (CoC) of Premier Limited (Corporate Debtor) in the 17^th CoC meeting held on 22.01.2022 with a majority of 92.47%.

2. Brief Background

2.1 This Tribunal vide its order dated 29.01.2021 (Admission Order) initiated Corporate Insolvency Resolution Process (CIRP) in respect of the Corporate Debtor and appointed the Respondent No.1 as the Interim Resolution Professional (IRP). The Respondent No.1 was subsequently appointed as the Resolution Professional (RP) of the Corporate Debtor.

2.2 The Applicant submitted a Resolution Plan dated 01.12.2021 which was approved by the CoC of the Corporate Debtor on 22.01.2022 with a majority of 92.47%. The Respondent No.1 filed an Application No. 395/2022 seeking approval of the Tribunal for the Resolution Plan
