NATIONAL COMPANY LAW TRIBUNAL

State Bank of India – Appellant
Versus
Mr. Manepalli Surya Manikyam – Respondent
IA (IBC)/368/2025

Advocates:
For the Applicant: Mr. G.P.Yash Vardhan
For the Respondents:

The Tribunal affirmed the right of financial creditors to initiate bankruptcy proceedings against personal guarantors for defaults in loan repayments under the Insolvency and Bankruptcy Code.

Headnote:(A) Insolvency and Bankruptcy Code, 2016 - Section 121 - Bankruptcy Proceedings initiated against Personal Guarantor due to defaults in repayment of loans secured for Corporate Debtor; Financial Creditor entitled to pursue bankruptcy as per applicable provisions. (Paras 1, 17)

(B) Financial Creditor’s rights under SARFAESI Act, 2002 and prior recovery proceedings; Corporate Debtor and Personal Guarantor failed to comply with recovery orders leading to initiation of bankruptcy process. (Paras 5, 6, 10)

Facts of the case:
The Financial Creditor filed an application under IBC to initiate bankruptcy proceedings against the Personal Guarantor due to significant defaults in loan repayments totaling over Rs. 178 crores, following several recovery notices and orders from the Debt Recovery Tribunal.

Findings of Court:
The court found sufficient grounds to declare the Personal Guarantor bankrupt due to non-compliance with repayment obligations and failure to submit a viable repayment plan.

Issues: The primary issue was whether the Personal Guarantor could be declared bankrupt given the defaults in loan repayment and non-compliance with prior court orders.

Ratio Decidendi: The Tribunal ruled that the Personal Guarantor's failure to comply with the repayment plan and previous orders justified the initiation of bankruptcy proceedings under the IBC.

Result: Mr. Manepalli Surya Manikyam is hereby ordered to be BANKRUPT.
