The Financial Creditor sought to initiate bankruptcy proceedings against the Personal Guarantor due to a significant outstanding debt of over Rs. 178 crores, following defaults and non-compliance with prior court orders.

Findings of Court:
The application to declare the Personal Guarantor as BANKRUPT was accepted due to the failure to submit a repayment plan and non-appearance in court.

Issues: The main issue was whether the Personal Guarantor could be declared bankrupt due to non-compliance with financial obligations.
