1. The present Company Petition has been filed under section 252 of the Companies Act, 2013 by M/s Greenfield Estates seeking restoration of the Company and re-instatement/re-activation of Director Identification Number of respective disqualified Directors.

2. The prayers in the present Petition are as follows:

a. Allow the Company Petition;

b. That this Hon'ble Tribunal may be pleased to set aside the order dated 18.09.2019 and notification in Official Gazette of India passed/issued by the Registrar of Companies, Pune and thereby striking off the name of M/s. Swiss Town Developers Private Limited from the Registrar of Companies, Pune.

c. Issue notice to the Respondent and after hearing the parties allow the Company Petition directing the Registrar of Companies, Pune, Respondent to restore the name of the said Company in the Register of Companies maintained by the Registrar of Companies, Pune as there is immovable asset in the said Company and it is carrying business and d. Directing the Respondent by themselves and/or through their servants and/or agents to reactivate the Director Identification Number(s)' of the Directors of said Company and allowing the said Company and their Directors to access the MCA21 online registry maintained by the Respondents;

e. Pass such other order/orders direction/directions as may deem just and proper in terms of Section 252 of the Companies Act,2013.

Brief Facts

3. The Company - Swiss Town Developers Private Limited was incorporated on 24/05/2010 as per the provision of Companies Act 1956 and CIN No.

U45200PN2010PTC136379.

4. The Petitioner has filed the present Petition under Section 252 of the Companies Act, 2013, seeking restoration of the name of the company on the Register of Companies maintained by the Registrar of Companies, Pune. The present petition has been filed by the Petitioner in the capacity of creditor of the struck-off company.

5. The authorised share capital of the Company is Rs. 1,00,000/-(Rupees One Lakh only) divided into 10,000 number of equity shares of Rs.10/- (Rupees Ten each) and the Issued, Subscribed & Paid Up Capital of the Company is Rs.1,00,000/-(Rupees One Lakh only) divided into 10,000 number of equity shares of Rs.10/- (Rupees Ten each).
