Approved insolvency resolution plans extinguish pre-existing claims against debtors, mandating claims to be filed during proceedings for enforcement, as per statutory provisions under the Insolvency and Bankruptcy Code.

Headnote:(A) Insolvency and Bankruptcy Code, 2016 - Section 60(5) - Application by Orchid Valley Apartment Buyers Association for transfer of property ownership - Seeking removal of encumbrances and directions to authorities - Resolution Plan approved on 14.08.2024, and all claims against the Corporate Debtor deemed extinguished post-approval - Respondent No. 5's objections regarding jurisdiction and claims rejected considering the binding nature of the approved Resolution Plan. (Paras 33-52)

Facts of the case:
The Orchid Valley Apartment Buyers Association applied for property transfers related to unresolved claims against the Corporate Debtor. The application followed the approval of a Resolution Plan on 14.08.2024, amid alleged inactions by Respondent No. 5 regarding title deeds and encumbrances.

Findings of Court:
The Tribunal identified a lack of jurisdiction in adjudicating public law issues and emphasized the binding effect of the approved Resolution Plan on all stakeholders.

Issues: The court dealt with the transfer of property ownership, the removal of attachments, and the legal obligations of the parties under the IBC.

Ratio Decidendi: The Tribunal reaffirmed that the Insolvency and Bankruptcy Code, 2016 supersedes previous claims once a Resolution Plan is sanctioned, removing liabilities on the Corporate Debtor, including those of secured creditors who failed to assert their claims during the CIRP.

Result: Application disposed of with observations.
