For the Respondents: Mr. Vikas Dutta, Mr. Siddharth Silwal, Ms. Shivani Sharma

The court permitted withdrawal of a Corporate Insolvency Resolution Process application under the Insolvency and Bankruptcy Code, affirming the applicant's right to withdraw before CIRP commencement.

Headnote:Under Section 60(5) of the Insolvency and Bankruptcy Code, 2016, the court considered the application for withdrawal of a Section 7 application by the financial creditor, Piramal Enterprises Limited, which sought to initiate Corporate Insolvency Resolution Process against Kay Jay Leasing. The applicant’s decision to withdraw follows previous orders and the fact that CIRP has not yet commenced against the corporate debtor. The court ultimately allowed the withdrawal and dismissed the Section 7 application as withdrawn.
