1. The present Application i.e. (IB)-560(ND)/2024 has been filed by CFM Asset Reconstruction Private Limited, the Applicant/Financial Creditor before this Adjudicating Authority under Section 7 of the Insolvency and Bankruptcy Code, 2016 (“IBC”) read with Rule 4 of the Insolvency and Bankruptcy (Application to Adjudicating Authority) Rules, 2016, (“Adjudicating Authority Rules”), for initiating the Corporate Insolvency Resolution Process (“CIRP”), against M/s. Canterbury Real Tech Private Limited, the Respondent/Corporate Debtor on the ground that the Corporate Debtor has defaulted to pay the outstanding principal amount of Rs. 58,60,00,000/-, interest (including redemption Premium) amounting to Rs. 65,96,30,117/- and default interest amounting to Rs. 88,51,34,136/-, TDS overdue amounting to Rs. 3,79,37,168/- totalling to Rs. 216,87,01,421/-.
2. The Respondent/Corporate Debtor filed a reply affidavit to the Section 7 Application and also filed an application i.e. I.A. 380(ND)/2025 under Section 65 of IBC, 2016 read with Rule 11 of the National Company Law Tribunal Rules, 2016 (“NCLT Rules”) seeking dismissal of IB- 560(ND)
