ORDER
1. The present application has been filed under Rule 11 of the NCLT Rules, 2016 for condonation of delay in filing the application for restoration. The applicant is seeking direction to condone the delay in filing the application for recall of the order dated Rest. Appl No. 01/2022 & MA No. 14 of 2023 IN CP NO.171/ALD/2017 20.09.2021 and allow the Rest. Application 01/2022 and set aside the order dated 20.09.2021 and restore the petition/application to its original number which was filed under Section 241 and 242 of the Companies Act, 2013.
2. Applicant states that due to some defect in the application, the said application was not cleared in the scrutiny by the registry of NCLT, Allahabad.
3. The applicant has also filed an application for Restoration of Company Petition No.: 171/ALD/2017 on 02.06.2022 wherein the Applicant has prayed to list this recall application for the recalling of the order dated 20.09.2021 and for listing simultaneously CP No. 171/ALD/2017 u/s 241-242 and Application No. 05/2019 u/s 213 of the Companies Act, 2013 in interest of justice.
