ORDER

Per Coram:

1. The present petition has been filed by Mr. Sandeep Khurana (hereinafter referred to as ’Petitioner’/ ’Operational Creditor’) u/s 9 of the Insolvency and Bankruptcy Code, 2016 (’The Code’), r/w Rule 6 of the Insolvency and Bankruptcy (Application to Adjudicating Authority) Rules, 2016 ("AA Rules"), for initiating Corporate Insolvency Resolution Process (CIRP), declaring moratorium and for appointment of Interim Resolution Professional (IRP), against M/s. Eco Hotels India Private Limited(hereinafter referred to as ’Respondent’/Corporate Debtor’), on the ground that it has committed default for a total amount of Rs. 1,24,90,476/- (Rupees One Crore Twenty Four Lacs Ninety Thousand Four Hundred and Seventy Six only)on account of Director’s Remuneration payable by the Corporate Debtor to the Petitioner.

2. A perusal of Part-I of the Form-5 reveals that Operational Creditor is one Mr. Sandeep Khurana, holding DIN: 02118658 and PAN AAAPK1573A having his address at D-17, Sector 39 Noida District Gautam Budh Nagar Uttar Pradesh 201303. The application is being submitted by the Petitioner himself and as such no authorization is enclosed.
