ORDER

1. The Application IA 935/2021 was filed on 27.4.2021 by Mr. Bhaskar Gopal Shetty (Applicant), the Resolution Professional of Mirage Ceramics Private Limited (“Corporate Debtor”), Under Section 43 , 45, 49, 50, 66, 60(5) of the Insolvency and Bankruptcy Code, 2016 (IBC Code), seeking following reliefs:

i. that the transactions mentioned at point nos. 5(A) to (E) above, be declared as void under Section 43 , 45, 49, 50, 66, 60(5) Of the Insolvency and Bankruptcy Code; and / or

ii. an order for reversal of the transactions mentioned at point nos. 5(A) to (E)above, under Section 43 , 45, 49, 50, 66, 60(5) Of the Insolvency and Bankruptcy Code be passed; and / or.

iii. that the promoters/directors or any party/ies who are carrying on the business with an intent to defraud the creditors may be made liable and directed to make such contribution towards the assets of the Corporate Debtor as this Hon'ble Tribunal may deem fit; and / or COMPANY PETITION NO. 571 (MB) OF 2019

iv. an order restoring the position as it existed before such transaction mentioned at point nos. 5(A) to (E) above, as if such transactions had not been entered into;
