The present Petition has been filed under Section 95 of the Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as Code IBC, 2016) read as rule 7(2) of IBC by the ”Bank of Maharashtra” represented by its Authorized Signatory (hereinafter referred to as Financial Creditor) seeking initiation of the Insolvency Resolution Process against ”Mr. N. Srinivasan”, Respondent/ Personal Guarantor who has executed personal guarantees in respect of the credit facilities extended to the Corporate Debtor, M/s. Garuda Vaayu Sakthi Limited
