O R D E R

1. The present Application is filed by the Successful Bidder, M/s Kalyani Steels Limited, in the liquidation process of M/s Kamineni Steel & Power India Pvt. Ltd/Corporate Applicant (since dissolved), under Section 60(5) of the Insolvency and Bankruptcy Code, 2016 (IBC), seeking directions to Respondent No. 1 to provide a new electricity connection in the name of the Applicant without insisting upon payment of the outstanding electricity dues owed by the erstwhile Corporate Applicant, M/s Kamineni Steel & Power India Pvt. Ltd.

Brief facts as averred in the Application

2. The Corporate Applicant, M/s Kamineni Steel & Power India Pvt. Ltd., was admitted into the CIRP by order dated 10.02.2017. During the CIRP, a Resolution Plan was approved by the Committee of Creditors and subsequently approved by this Tribunal vide order dated 27.11.2017. However, the said approval was set aside by the Hon’ble NCLAT vide order dated 06.09.2018 and remitted the case to this Tribunal with a direction to initiate liquidation proceeding against the Corporate Applicant.

3. Consequent thereto, liquidation of the Corporate Applicant commenced on 26.10.2018 in compliance with the directions of the Hon’ble NCLAT. Upon issuance of the 6th e-auction notice, the Applicant was declared as Successful Bidder on 05.01.2024 for a consideration of Rs.450 crores, which was duly paid the Applicant. The Liquidator thereafter issued a Sale Certificate dated 10.02.2024 and handed over physical possession of the assets to the Applicant. After completion of the liquidation proceedings, the Corporate Debtor stood dissolved vide order dated 10.05.2024.

4. Subsequently, the sale certificate was taken on record by the Sub-

Registrar Nalgonda in Book-I on 26.06.2024.

5. After taking possession, the Applicant vide letter dated 28.01.2025 requested Respondent No. 1 for a fresh electricity connection to undertake overhauling and maintenance of the plant and Machinery of 350,000 MTPA Steel Billet Plant located in Cheruvugattu Village, Narketpally Mandal, Nalgonda District. Respondent No. 1, vide letter dated 28.02.2025, refused to grant the connection and demanded payment of Rs. 34,61,31,292/- towards outstanding electricity dues of the Corporate Applicant i.e. M/s Kamineni Steel & Power India Pvt Ltd by relying on Hon’ble Supre
