O R D E R

1. These petitions have Lakshmi Venkateshwara Traders been filed by M/s.

(hereinafter referred to as ‘Petitioners/Operational Creditors’) on 12.12.2025 (CP(IB)/39/KOB/2025) and M/s.RS Melgiri & Company (CP(IB)/2/KOB/2026) and 15.01.2026 respectively, under Section 9 of the Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as the “Code”), read with Rule 6 of the Insolvency and Bankruptcy (Application to Adjudicating Authorities) Rules, 2016, for initiating the Corporate Insolvency Resolution Process (hereinafter referred to as “CIRP”), declaring moratorium and for appointment of Interim Resolution Professional (hereinafter referred to as “IRP”) against the Corporate Debtor Private Limited.

2. M/s. KKR Products and Marketing Operational Creditors against the same Corporate Debtor. Having considered to CP(IB)/39/KOB/2025 and CP(IB)/2/KOB/2026 have been iled by two different the attending facts and circumstances of both cases, the defence raised, and the submissions advanced by the respective parties, this Adjudicating Authority is of the considered opinion that both the petitions can conveniently be adjudicated by way of a common order. Such a course will not cause any prejudice to any of the parties concerned.

3. The Petitioner/Operational Creditor, in CP(IB)/39/KOB/2025 was incorporated on 01.07.2017 as a sole proprietorship M/s. Lakshmi Venkateshwara Traders Stage, Bangalore Road, Ballari, Ballari District, Karnataka – 583101. The firm is concern, having its office at Plot Nos. 47 and 48, Mundargi Industrial Area, 2nd engaged in the business of manufacturing, processing, and supplying dry chillies, along with other allied and incidental activities.

In the matter of , the total amount claimed to be in default, as set out in Part IV of the Petition, as on 11th February 2022, is

of Rs. - (Rupees One Crore Forty-Nine Lakh Eighty-Five Thousand Seven Hundred Twelve and Forty-Two Paise) along with interest

1,49,85,712.42/

claimed at 18% per annum amounting to Rs. 86,22,272.00 (Rupees Eighty-six Lakh, Twenty-two thousand, Two hundred Seventy-Two only).
