1. The present petition has been filed on 28.11.2025 under section 9 of the Insolvency and Bankruptcy Code, 2016 (“IBC”), read with Rule 6 of the Insolvency and Bankruptcy (Application to Adjudicating Authority) Rules, 2016, by Royal Fleets Private Limited seeking initiation of Corporate Insolvency Resolution Process (“CIRP”) against Pace Digitek Limited for alleged default in payment of operational debt amounting to Rs.1,04,94,784/-, comprising principal amount of Rs.1,02,74,002/- and interest of Rs.2,20,781/- as on the date of filing of the petition

2. Brief relevant facts of the Petition are given hereunder:

a. The Petitioner/Operational Creditor is engaged in the business of transportation and fleet management services whereas the Corporate Debtor is engaged in providing infrastructure and telecom related solutions across India. The parties entered into Transport Service Agreements effective from 01.10.2024 to 31.12.2024 and further extended from January 2025 till June 2025 whereby the Operational Creditor agreed to provide transportation and fleet services to the Corporate Debtor. The Petitioner issued Thirty-two invoices for the period from 24.04.2025 to 14.07.2025 The said invoices, as per the Petitioner, were to be paid within Forty- Five days of issuance, failing which interest at the rate of 18% per annum would be levied on delayed payments.

b. Pursuant to the said arrangement, the Operational Creditor rendered services during the period from October 2024 till May 2025 and raised multiple invoices from time to time in accordance with the agreed terms but despite due acceptance of services and clear liability, the Corporate Debtor persistently delayed and defaulted in making timely payments even though an amount of around Rs.52.59 lakhs was already overdue by February 2025.

c. Subsequently, between 15.05.2025 and 28.08.2025 the Operational Creditor sent repeated email reminders to the Corporate Debtor regarding pending dues and urged immediate release of dues. On 26.05.2025, the Corporate Debtor responded by email acknowledging the outstanding amount and assuring that the payment was being processed but despite such assurances and acknowledgment of liability, the Corporate Debtor failed to honor its commitment, and no substantial payment was received thereafter. The outstanding amount continued to increase as further invoices became due and remained unpaid.

d. On 30.08.2025 with no payment forthcoming, the Operational Creditor issued a Demand
