(Physical Hearing This application has been filed by NSL Wind Power Company Private Limited, under Section 60(5) of Insolvency and Bankruptcy Code 2016 r/w Rule

11 of NCLT Rules 2016 Limited seeking the following reliefs, a) To direct the Respondents to approve the claim amount of Rs. 20,94,49,804/- (Twenty Crores Ninety-Four Lakhs Forty Nine Thousand Eight Hundred and Four Rupees only)

to the Applicant.

FACTS OF THE CASE

1. The corporate debtor Regen Infrastructure private limited was admitted to CIRP vide order dated 19.02.2020 in IBA/1424/2019.

2. It is submitted that That the Applicant had set up a project for the generation of electricity by means of wind Electric Converters with 49.5 MW installed capacity using wind energy comprising of Thirty-Three (33) Numbers of ReGen make Wind Energy Converters ("WEC"). Each WEC having a rated output of 1500 kw capacity, at their plot of land at Vadugapalayam, Illupanagaram, Virugalpatti, Kondampatti, Somavarapatti, Kottamangalam, Anikadavu, J. Krishnapuram, Senjeriputhur, Thalakkarai, S. Ayyampalayam, Pukkulam, Kammlapatti & Amandakadavu Villages, Udumalpet, Madathakulam & Sulur Taluks, Tirupur & Coimbatore Districts, Tamilnadu, India.

3. The Applicant had entered into an Operation & Maintenance Agreement dated 12.05.2012 with Regen Powertech Private Limited ("RPPL"). The said RPPL at the time of the execution of the Agreement was engaged in the business of operating and managing projects for generating the electricity by means of Wind Electric Converters on behalf of the owners of Wind Farm like the Applicant herein.

4. It is stated that after a period of two years of looking after the Operation &

Maintenance in accordance with the said Agreements, RPPL eventually executed a 'Business Transfer Agreement' (BTA) dated 05.03.2014 with the Corporate Debtor. It is stated that as per the terms of the said BTA, the transfer of the rights and obligations of the RPPL under the above-
