The present Company Petition bearing No. CP/16/241/AMR/2022 (hereinafter referred to as the “Petition” or “CP 16/2022”) was e-filed on 17.12.2022 and physically filed on 23.12.2022 vide Diary No. 1487 by Mrs. Nishi Shukla (hereinafter referred to as the “Petitioner”) under Sections 213, 241 to 244, 337 to 341 and other applicable provisions of the Companies Act, 2013 (hereinafter referred to as the “CA, 2013”) against Digisprint Solutions Private Limited (hereinafter referred to as the “Respondent No. 1” or “R-1 Company”), Mrs. Nirmala Sakkuri (hereinafter referred to as the “Respondent No. 2” or “R-2”), Mr. Govirdhan Rao Sakkuri (hereinafter referred to as the “Respondent No. 3” or “R-3”) and Mr. Kamalesh Bopchand Sharma (hereinafter referred to as the “Respondent No. 4” or “R-4”) seeking following reliefs:

Interim Reliefs:

(i) To direct R-1 Company to make the Petitioner co-signatory for the all the bank accounts of the R-1 Company till the matter is disposed.

(ii) To direct a forensic audit of the R-1 Company to be conducted.

(iii) To direct R-1 Company not to enter into any agreement(s) or arrangements having financial implications on the affairs of R-1 Company, including but not limited to payments of any nature to the Cubes Collaborative Spaces Private Limited (hereinafter referred to as the “CCSPL”), till the matter is decided.

(iv) Pass such order or orders, as this Tribunal may deem fit and proper, in the facts and circumstances of the case.

Relief(s) Sought:

(i) To reinstate the employment of the Petitioner along with all the employment emoluments including salaries till date.

(ii) To direct the R-2 & R-3 to return the 1250 number of Equity Shares, which has been transferred to R-2, back to the Petitioner.

(iii) To direct the R-1 Company to make the Petitioner co-signatory for all the bank accounts of the R-1 Company.

(iv) To direct the Respondents to comply with all mandatory requirements under the applicable provisions of the CA, 2013;

(v) To direct the Respondents to reconvene the Annual General Meetings for the previous financial years and pass all the required resolut
