1) Mr. Vinod Chaurasiya, Ld. Counsel for the Applicant/Interim Resolution Professional is present.

2) The present Interlocutory Application has been filed by the Applicant/Resolution Professional of the Corporate Debtor under Section 22(3)(a) of the Insolvency and Bankruptcy Code, 2016 read with regulation 3(1A) of IBBI Regulations 2016 seeking to place on record the decision of the Committee of Creditors confirming the Interim Resolution Professional as the Resolution Professional of the Corporate Debtor.

3) It is submitted that the First Meeting of the Committee of Creditors was convened on 25.05.2026, wherein the agenda for confirmation of the Interim Resolution Professional as the Resolution Professional was placed before the Committee for consideration. Pursuant to the deliberations of the Committee, the matter was put to e-voting from 27.05.2026 to 29.05.2026. The Committee of Creditors, with 100% voting share, approved the appointment of Mr. Rajneesh Kumar Aggarwal as the Resolution Professional of the Corporate Debtor under Section 22(3)(a) of the Insolvency and Bankruptcy Code, 2016.

4) The Resolution passed by the Committee of Creditors is quoted below for the convenience:

Resolution:

To consider and if found fit, to pass with or without modification the following Resolution:

"RESOLVED THAT Mr. Rajneesh Kumar Aggarwal, an Insolvency Professional (Registration No.- IBBI/IPA-001/IP-P00886/2017-18/11483), be and is hereby appointed as the Resolution Professional in the matter of Corporate Insolvency Resolution Process of PS IT Infrastructure & Services Limited in accordance with provisions of section 22(3)(a) of the IBC- 2016."

5) It is noted that Section 22(3)(a) of IBC has been amended by Insolvency and Bankruptcy Code, Amendment Act, 2016 w.e.f. 26.05.2026 whereby the Interim Resolution Professional appointed as Resolution Professional by the CoC is deemed to be appointed as the Resolution Professional from the date of such Resolution, and this decision shall be communicated to the Interim Resolution Professional, the Corporate Debtor, and the Board. It is further noted that the CoC had passed a Resolution prior to such amendment, however the application has come on board after notification of said amendment, which is procedural in nature. In view of this, we take on record the fact of the appointment the Interim Resolution Professional appointed as Resolution Professional by the CoC and direct the Interim Resolution Professional to discharge the duties and function in the CIRP process as Resolution Professional.

6) Nonetheless, the present Application placing on record the appointment of Mr. Manish Lalji Dawda, as the Resolution Professional of the Corporate Applicant and the written consent of the Proposed Resolution Professional in FORM AA is taken on record.

7) With the aforesaid observations, the Interlocutory Application bearing IA No. 2357 of 2026, is disposed of as Allowed.
