ORDER

1. The present Original Application has been filed with the prayers that a restraint order be passed to all the respondents from taking action against the applicant- M/s Aaravi Transport, which is carrying out the work of land filling with Construction and Demolition waste; the impugned order dated 23.06.2023 passed by the respondent No.4- Executive Engineer (SWM Zone-VII), Municipal Corporation of Greater Mumbai, which is annexed at page no.150 of the paper book, directing the applicant to stop the work of land filling C&D waste material at land bearing CTS No.2330/A/1/1 (pt.), 2321 & Survey No.345-C, Kajupada, Ashokvan, Shiv Vallabh Road, Hanuman Tekdi, Dahisan (East), Mumbai- 400 068, be quashed and set aside; issue necessary directions to all the respondents for restoration of the permission dated 16.12.2022 passed by the Brihunmumbai Municipal Corporation, which is annexed at page nos.134-135 of the paper book, granted to the applicant for land filling;

and a Committee be constituted to assess the loss caused to the applicant and adequate compensation be awarded to the applicant.
