ORDER
1. The main question involved in this application is degradation of environment with respect to utter violation of guidelines of the Bio Medical Waste Treatment Facility and Direction issued by the Central Pollution Control Board.
2. The issue involved in the present Original Application is that the Non-Applicant No. 6 - M/s. Medical Pollution Disposal Committee, Kanpur is planning to set up a Common Bio Medical Treatment Facility at an agriculture land in village Dumduma Tehsil Karera of District Shivpuri. The paramount issue is that the land, over which the Non-Applicant No.6 is planning to establish its CBWTF, is falling under the prohibited zone of Karera Wildlife Sanctuary, the Eco Sensitive Zone of which was notified on 15.09.2017. The CBWTF falls under the Red Category of industry and requires Environment Clearance in terms of the EIA Notification, 2006. The Non-Applicant No.6 has furnished all incorrect affidavits and information before Madhya Pradesh State Environment Impact Assessment Authority (MPSEIAA), which has failed to acknowledge the objections filed before the Department and despite of them, the Terms of Reference (TOR) have been issued.
