Absolute liability for hazardous industrial accidents requires standardized compensation to victims' families, payable by state authorities if project proponent fails.

Headnote:Under Section 15(1) and Section 17 of the National Green Tribunal Act, 2010 (NGT Act), and Public Liability Insurance Act, 1991 (PLIA), the Tribunal has jurisdiction to grant compensation for death or injury from handling hazardous substances in violation of scheduled enactments. A massive fire at an illegal paint factory in a densely populated non-conforming area of Delhi’s Alipur on 15.02.2024, caused by welding near chemical drums, resulted in 11 deaths and 4 injuries, with chemicals spreading fire to adjacent structures. The factory violated environmental norms, including Manufacture, Storage and Import of Hazardous Chemical Rules, 1989, and Supreme Court orders restricting industries in residential areas. The court found absolute liability for hazardous activities and non-compliance with safety norms. Key issues involved determining compensation under NGT Act Schedule II for victims not covered under workmen compensation, and ensuring remedial measures. The Tribunal applied the ratio of absolute liability from prior decisions, holding responsible parties liable for restitution, with state authorities paying and recovering from violators. Prior NGT orders in similar fire/gas leak cases awarded standardized compensation, emphasizing statutory compliance failures. The OA is disposed of, directing Rs. 20 lakhs compensation to each deceased's family members, with differential amounts payable by SDM (Alipur) within two months, recoverable from the project proponent, without prejudice to higher claims elsewhere.
