NATIONAL GREEN TRIBUNAL NEW DELHI (PRINCIPAL BENCH)
Sudhir Agarwal, Judicial Member, A. Senthil Vel, Expert Member, Afroz Ahmad, Expert Member
Sanjeev Jain – Appellant
Versus
Municipal Corporation of Delhi – Respondent
Original Application No. 559/2022 (I.A. No. 237/2022)

Advocates:
For the Appellants/Petitioners: Applicant in Person
For the Respondents: Ms. Jyoti Mendiratta, Ms. Puja Kalra, Mr. Amar Gupta, Mr. Anupam Verma, Mr. Aditya Gupta

Land with incidental greenery and public use not deemed public park without statutory designation or approved layout plan.

Headnote:Under Sections 14 and 15 read with Section 18(1) of the National Green Tribunal Act, 2010, the applicant alleged illegal possession and damage to greenery in a public park by installation of transformers, violating Article 21 rights and environmental duties under Article 51. The court found no approved layout plan designating the site as a park; it was marked as road land transferred to PWD. Respondents submitted joint inspection reports confirming no park maintenance by MCD and absence of permissions from DPCC and DFS. Key issues: (I) Whether the site is a public park? (II) Whether it was illegally damaged? The court held mere greenery, benches, and public use do not confer public park status without statutory designation; approved 1983 layout plan shows road use only. Tribunal's jurisdiction limited to Schedule I statutes; local construction permissions outside scope. Original Application dismissed; no merit found. Pending IA disposed of.
