ORDER
1. The Original Application 362/2023 was registered in the National Green Tribunal, New Delhi Bench on the basis of a letter petition dated 03.02.2023 received from the Applicant-Laddu Sahni.
2. The complainant has stated that Kanti Bijlee Utpadan Nigam Limited (hereinafter referred to as ‘proponent’) at Kanti, District Muzaffarpur is discharging chemical waste water and coal ash in a pond at khasra no.1754, area 1450D, causing loss to fish production and environmental damage.
3. It appears that an earlier O.A. No.272/2019, Satyanarayan Sahni vs. State of Bihar , was filed which was disposed of by the New Delhi Bench of the Tribunal vide order dated 28.09.2020 which reads as under:-
