Petrol pump siting complies with CPCB 50m distance guideline from schools, hospitals, designated residences; application dismissed.

Headnote:The application challenges permissions for a petrol pump outlet citing violations of CPCB guidelines (Section-H, dated 07.01.2020) and Petroleum Rules, 2002, requiring 50m distance from schools, hospitals, and designated residential areas. Essential facts include site at Khasra No. 109/1/2 on SH-10, Bhopal, with joint committee inspection confirming no schools, hospitals, or designated residences within 50m; nearest habitation 600m away; consents issued under Water (Prevention & Control of Pollution) Act, 1974 (S.25) and Air (Prevention & Control of Pollution) Act, 1981 (S.21). Court finds statutory permissions valid, no guideline violations, unauthorized colonies nearby not counting as designated areas. Issues framed: Whether NOC and consents violate siting criteria; jurisdiction under NGT Act, 2010 (Schedule I excludes Petroleum Rules). Ratio: Joint committee report verifies compliance; no protected establishments within 50m radius from dispensing units; PESO approvals ensure safety; land use changes under revenue domain, not NGT; applicant's objections unsubstantiated (paras 4, 12-14, 21). Application dismissed as devoid of merit.
