NATIONAL GREEN TRIBUNAL NEW DELHI (PRINCIPAL BENCH)
Sudhir Agarwal, Judicial Member, Afroz Ahmad, Expert Member
Syed Riyaz – Appellant
Versus
Union Territory of J & K – Respondent
Original Application No. 594/2022

Advocates:
For the Appellants/Petitioners: None
For the Respondents: Ghansham Singh

Brick kilns must obtain consents and comply with environmental norms; pollution authorities to enforce closures, impose compensation on violators, with High Court orders prevailing over Tribunal directives.

Headnote:(A) Environmental Protection Laws - Air (Prevention and Control of Pollution) Act, 1981 - Sections 31(A), 37; Water (Prevention and Control of Pollution) Act, 1974 - Section 41 - Brick kilns operating without consent to establish/operate and violating environmental norms - Tribunal constitutes joint committee for verification, directs closure of non-compliant units, imposition of environmental compensation, and strict enforcement by pollution control authorities and district magistrates - No new kilns permitted without compliance; zig-zag technology mandatory in specified areas by deadlines - High Court interim orders prevail over Tribunal directions - Persistent violations despite repeated orders warrant coordinated action for compliance. (Paras 2, 4-39)

(B) Judicial Enforcement - Pollution control board required to issue closure directions, file complaints in courts, levy environmental compensation on violators, and ensure implementation through district administration - Status reports mandated with public disclosure on website - Personal attendance of officials ordered for accountability - Contradictory reporting by authorities noted, leading to directives for proper functioning. (Paras 16-22)

Facts of the case:
Letter petition raised grievance of numerous brick kilns operating illegally without consents, using unscientific systems causing air pollution and health hazards. Tribunal issued notices, formed joint committee, received multiple status reports showing hundreds of non-compliant kilns, directed closures, technology upgrades, and enforcement. Despite actions, violations continued with some units resuming operations and seeking High Court protection.

Findings of Court:
Out of total brick kilns, significant numbers lacked valid consents; closure orders issued and mostly implemented; environmental compensation levied on defaulting units; violations reported post-closure with court complaints filed.

Issues: Whether brick kilns can operate without environmental clearances and compliance; enforcement of closure orders against persistent violators; precedence of High Court interim orders; measures for pollution control board accountability.

Ratio Decidendi: No brick kiln can operate without prior consents and environmental norm compliance; authorities must enforce closures, levy compensation, and coordinate with district officials; High Court orders supersede Tribunal directions; ongoing monitoring via compliance reports essential to prevent violations.

Result: Original Application disposed with directions for enforcement against specific non-compliant kilns, compliance of closure orders within two months, further reports; High Court orders to prevail where applicable.
